Activity No. (7/ 2016/ Protection) (Ye Kyaw Thu)

  1. On 4.9.2015, the Commission received a letter of complaint dated 3.9.2015 from Daw Mwe Hpu Htu. The complaint stated that on 19.6.2015, Infantry Regiment (250) arrived at Zee Kyun Ward, Karmaing Township, Kachin State and took away (4) villagers. On 25.6.2015, (3) of the villagers were released. Although Daw Mwe Hpu Htu learned that her son in law U Tu Ja was dead, she did not see his dead body. She sent the above mentioned letter of complaint stating that she wished to bury the body after performing religious rites and wanted action to be taken against the responsible persons for destroying and concealing evidence of the dead body.
  2. On 11.1.2016, the Commission conducted a hearing on the complaint and forwarded the complaint to the Ministry of Defence for investigation and to uncover the truth.
  3. On 21.1.2016, a reply was received from the Ministry of Defence stating that the dead person was Sergeant Tu Ja, personal identity no. B.13479 from No. (3) Company, KIA No. (6) Regiment. On 5.10.2015, his body was exhumed and an autopsy was performed. On 6.5.2015, a reply was received from the Ministry of Defence that Major Ye Kyaw Thu, the person responsible, was being tried by a military court for falsely reporting on the incident, destroying and concealing evidence of the dead body.
  4. On 25.2.2016, the Commission sent a letter to the Ministry of Defence, requesting a reply on the progress of investigation on the case. On 11.3.2016, the Ministry of Defence sent a reply stating that Major Ye Kyaw Thu was given a summary trail by the Chief Military Court (156/2015) and was dismissed.
  5. The action taken by the Ministry of Defence was conveyed to the complainant on 6.5.2016.
